General Terms and Conditions of Sale

These terms and conditions govern sales concluded on the lushko.com website between Lushko (“the Seller”) and any customer (“the Customer”).

1. Seller identification

Lushko, trade name of Marwan Essaouag, sole proprietor (Dutch eenmanszaak), registered in the trade register under the name Essa Cars. Address: Passerstraat 2, 5632 EN Eindhoven, the Netherlands. KVK 93139950 · VAT NL005001661B11. Email: contact@lushko.com.

2. Products

The products offered are described and presented as accurately as possible. The images are as faithful as possible but cannot guarantee a perfect likeness (colours, details). We select our pieces from partner suppliers; we do not manufacture them ourselves.

3. Prices and discounts

Prices are shown in euros or, depending on the country selected, in that country’s currency, excluding delivery costs, which are specified before the order is confirmed. For delivery within the European Union and to Monaco, prices include all taxes (VAT included) and any customs duties are paid by us: you have nothing to pay on delivery. For delivery outside the European Union, and to the French overseas territories, the Canary Islands, Ceuta and Melilla, customs duties, import taxes and any clearance fees of the destination country are not included; they may be requested by the carrier on delivery (see our Delivery & Shipping page). The applicable price is the one displayed at the time of your order.

Two automatic discounts apply from 2 items in your basket: a 10% discount on the basket total, and free delivery. They are applied automatically and shown before payment; you do not need to enter any code. The 10% discount is permanent: it is not limited in time, and its rate does not increase beyond 2 items. Free delivery from 2 items is valid until 31 December 2026.

These two automatic discounts can be combined: from 2 items, you get both the 10% discount and free delivery. A promotional code, however, cannot be combined with the automatic 10% discount: if you enter a code while that discount already applies to your basket, the automatic discount is kept and the code is not applied. When a promotional code is given to you, its conditions (rate, duration, any minimum amount) are stated to you at that time. The amount finally applied is always shown in your basket before payment.

The free delivery threshold stated on our Delivery & Shipping page is assessed on the amount after deduction of discounts: if a discount brings your basket below this threshold, delivery costs apply — unless your basket contains at least 2 items, in which case delivery is free whatever the amount. The exact amount is shown in your basket before payment.

4. Order

Any confirmed order constitutes acceptance of these General Terms and Conditions of Sale. A confirmation email summarises your order.

5. Payment

Payment is made securely online using the methods offered at checkout. The order is processed after payment has been confirmed.

6. Delivery

Delivery time: 5 to 13 days from the confirmation of your order. This time is a total: it includes preparation, transport and delivery to your home. It is counted in calendar days, including weekends and public holidays.

Our items are shipped directly by our partner suppliers, who handle the shipping themselves. This is what explains our prices, and it is also the reason for this delivery time. An order of several items may reach you in several parcels, on different dates, at no extra cost.

If your order is not delivered within this time, you may ask us, by email or by post, to deliver within a reasonable additional period. If it is not delivered within that additional period, you may cancel the order in the same way; we will then refund everything you paid, including delivery costs, no later than 14 days after the cancellation.

7. Right of withdrawal

The Customer has 14 days to withdraw, in accordance with the terms set out on our Returns & Refunds page. In the event of withdrawal, standard delivery costs are refunded; only the cost of sending the items back remains payable by the Customer.

8. Legal guarantees

All products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

9. Liability

The Seller cannot be held liable for damage resulting from misuse of the product. No clause of these terms and conditions may have the effect of depriving the Customer of the rights granted to them by law as a consumer.

10. Applicable law and disputes

These General Terms and Conditions of Sale are governed by Dutch law. This choice does not deprive the Customer of the protection afforded by the mandatory provisions of the law of their country of habitual residence (Article 6 of the Rome I Regulation). Failing an amicable settlement, French consumers may contact the Centre Européen des Consommateurs France (European Consumer Centre France) free of charge (europe-consommateurs.eu).
